As we continue to review much of the compelling public comment to the Strategic Evaluation Committee report we’re all left wondering, just as we wondered before when the SEC was appointed with a one year evaluation period-
Is this all a delay tactic with the hope that it will all blow over and time will heal all wounds? Or is this a valiant attempt to run out the statute of limitations before finally succumbing to calls for democracy so that a few really nice people who did some really bad things walk away?
What is it that permits an attorney to work in Minnesota, another one to work in Switzerland and have a scholar in residence, living in Virginia no less to remain on the AOC’s payroll? What is it that has Teflon Jack back on the bench in Shasta County after a second retirement?
What it is, is a leadership crisis. Our Chief Justice appears to be too submissive to lead, relying instead on the purported leadership of others.
Can you remember just one time since she has taken office where you heard the words “I’ve directed my AOC staff to”…… do……. anything? Where is the leadership?
Ultimately as Chief Justice, she is relied upon to make choices of whom will sit on the judicial council, making those choices from a small group of closely vetted judges and justices. They’re vetted by some of the same people that created this governance train wreck to begin with.
Do you believe that we’re going to suddenly start seeing some leadership from the judicial council or the chief justice with respect to implementing the provisions of the SEC report and stop our trial courts from dying off en masse? We’ve all been patiently waiting for it, enduring survey and comment fatigue. The same consistent comments, the same consistent theme. And yet the lady in the ivory tower on the corner of McAllister and Polk appears to be oblivious to the fact that there actually might be a problem even though more than a hundred and fifty of her colleagues are publicly ringing the alarm bell, including the very committee she appointed to give her the answers she said she needed.
Well Tani, you have your answers.
You have more than 425 members of the Alliance of California Judges telling you there’s a problem and ironically, they are speaking with one voice. There are more than 11o comments that indicate there’s a problem and I am guessing about a quarter of those are ACJ judges. You have the very committee you commissioned telling you there is a problem.
Good people that our public relies upon and important services offered only in our local trial courts are far more important than $1,900.00 per square foot courthouses, $2,500.00 light bulbs and zombieware. All of these associates of yours are trying to tell you in the most decorum filled, respectful manner possible and you’ve tuned them out. You’ve permitted both the Judicial Council and your AOC divisions to try and undermine the SEC report by proxy, while either standing behind the curtain playing puppetmaster or permitting others to do so in your stead.
Supporting you are the “gee, I don’t know” and “I don’t think I appreciate the tone of the report” crowd. We’ll just call them the dead fish among your judicial council colleagues. The issue here is that the putrid stench from all of these rotting dead fish that have no leadership skills themselves is now bleeding over to the rest of the judicial branch. So do you really believe more of the same is in order? When you took office, there was much hope. Now even in your ancestoral homeland they have lost faith in your leadership – or lack thereof.
That stench is now spreading throughout the entire judicial branch and it is beginning to affect 38 million Californians adversely. Yet all you have to do is demonstrate just a little leadership. Not much. But as the leader of the largest judiciary in the western world, leadership seems beyond you.

At present, the branch is all about top leadership’s ego. Unless and until our gambling barmaid — who most emphatically did NOT have the background or experience to become CJ of the biggest judiciary in the Western World, gets past hers, we will not have any meaningful top leadership at all. She is still in front of her magic mirror, admiring her “it’s good to be Queen” pretend crown — when long ago she should have put on her apron and rubber gloves, and hauled out the disinfectant.

It seems you are right, Wendy.
So many people (for example, check out JCW’s amazing Hall of Fame) have informed top leadership of their concerns, over and over, in different ways– officially (in studies, surveys, audits and comments), directly (via letters), and via legislative proceedings and the media. It has taken a revolution– effectively an all-out concerted assault on top leadership and it’s wasteful, mismanaged projects and policies–and the intervention of the other two branches to force the changes we have seen.

This Chief Justice is a major disappointment. In her defense, she arrived when the branch was restless after years of problems created by former CJ George , his supporters and an out of control AOC. While the new Chief seemed more open than the former CJ she blundered early by backing the AOC on the virtues of CCMS. She then did something bold by creating the SEC and appointing a fair and very thoughtful Judge to head up the committee, J Scotland. J Scotland in turn set up a fair process to review the AOC. J Scotland’s exit around the time the first Interim SEC report was to be presented was extremely troubling.Then out of the blue and to the shock of the insiders at 455 Golden Gate, AB 1208 passed. The Chief Justice’s misplaced attack on members of the state Assembly was also a cause for significant concern as these same legislators would ultimately be voting on a budget for the branch as a whole. The SEC report was finally complete and to the Chief Justice’s credit ,the report was made public. The findings of the SEC were devastating to the AOC . CCMS having been consigned to the trash heap of history, the Chief Justice had the perfect opportunity to embrace the SEC report and urge that the recommendations set forth in the report be adopted forthwith. After all, the membership of the SEC was made up of all appointees of the Chief Justice. Urging the implementation of the SEC recommendations would have been a huge step in healing the branch and restoring branch credibility. Sadly the Chief Justice squandered yet another opportunity instead opting for delaying the SEC recommendations by having J Miller and his insider E and P committee start all over again evaluating the evaluation. My read on all this is that this Chief Justice came to power committed to honoring the purported legacy of former CJ George and she will hunker down and protect that legacy at any cost while the public, trial courts and their hardworking employees pay the price. Two things now how to happen to restore integrity , balance and common sense to our branch. The Judicial Council needs to be democratized and this Chief Justice recalled.

The current Chief Justice was a voting member of the Judicial Council for several years at the same time the very problems created by former CJ Ron George and an out of control AOC were taking place. Not only was she a voting member of the Judicial Council during that time, she endorsed, supported, and voted for the very conduct, measures, and actions, that have now led branch administration to disgrace, and she has continued those practices, and her unwaivering support of Ron George, unabated since assuming the Office of the Chief Justice.
None of what is now happening to the branch should be a surprise to her, given that she was, and is, a willingly participant in making it happen.
Long live the ACJ.

The entry by JusticeCalifornia comes across as too strong, especially since it can be perceived (incorrectly — on first glance) to suggest Californians would be better-off if only Cantil-Sakayue remained loyal to the gambling industry, as part of a casino janitorial crew scrubbing away bathroom graffiti.
As to the issue of “too submissive to lead,” It’s hard to escape the troubling thought that similar to Holly Fujie and Jayne Kim, the power to be positioned Cantil-Sakayue knowing she can be manipulated to serve their own interests. For example: http://tinyurl.com/friendoftani

Food for thought – it appears at first glance that the judicial branch has closed more courtrooms than all of the courtrooms that are slated for construction. Mr. Hill needs to face fiscal reality and concentrate his efforts not by cutting courthouse construction costs but by cutting courthouse construction projects so that he can justify all of those empty courtrooms.
